Each year, thousands of workers in Queensland are injured in the course of their employment. A work-related injury is 'a personal injury arising out of, or in the course of, employment if the employment is a significant contributing factor to the injury.' An injury can be physical, psychological (anxiety or depression), in the form of a disease, an aggravation of a previous condition or death from an injury or disease. An injury can be sustained while at work, travelling to or from work, whilst working from home or even while on a break at work. Time Limits2/9/2025 For most personal injury claims, a legal action must be commenced within 3 years of the date of the injury. If you miss this deadline, you will lose the right to claim compensation.
However, depending on where your injury occurred or who you are claiming against, specific pre-court procedures may apply which may have much shorter time limits.
