A work-related injury is 'a personal injury arising out of, or in the course of, employment if the employment is a significant contributing factor to the injury.' An injury can be physical, psychological (anxiety or depression), in the form of a disease, an aggravation of a previous condition or death from an injury or disease. An injury can be sustained while at work, travelling to or from work, whilst working from home or even while on a break at work. Most injured workers are not aware of all of their injury-related losses and sometimes miss out on compensation they are entitled to. Seek medical assistance Your health and recovery are the most important things after being injured at work. Early intervention is always a positive! You should report the injury to your health practitioner and provide as much information as possible as to how the injury was sustained. When you see your health practitioner, you should ask for a work capacity certificate. This will tell you whether you are able to work or require some time off. 2. Report your injury to your employer After a work-related accident occurs, you should report it to your employer as soon as possible. If you were given a work capacity certificate by your health practitioner, you should give this to your employer. Reporting the injury is important for a number of reasons. It ensures there is a record made of the incident as soon as possible after it happens. The sooner the report is made the better, as it will be more accurate being fresh in your mind. It also means there is a contemporaneous record of your injury. If the incident was serious, your employer may have to report it to Workplace Health and Safety Queensland. 3. Lodge a claim with WorkCover Queensland (or notify your employer if they are self-insured) In order to start the claims process, you will need to lodge a claim with WorkCover Queensland. In order to do this, you will need to have the details of the incident ready, such as the date, time, location and how the injury came about. If your employer is self-insured, they may provide you with assistance on how to lodge a claim. 4. Start your rehabilitation without delay It has been proven that returning to work is helpful to your recovery process. You should follow the advice of your health practitioner and treatment providers so that your rehabilitation starts as soon as possible. 5. Talk to a lawyer It is important that you seek some legal advice in relation to your injury. There may be compensation that you are entitled to that you are not aware of.
